PUBLIC HEARING NOTICE
Notice is hereby given that the Bismarck Planning & Zoning Commission will hold public hearings on Wednesday, August 25, 2021, at 5:00 p.m. in the Tom Baker Meeting Room, City-County Building, 221 North 5th Street, Bismarck, North Dakota, to consider the following items:
• Request of Dan Potter and Wayne and Jennifer Harvison for approval of a zoning change from RR – Residential zoning district to the RR – Residential and R5 – Residential zoning districts and a minor subdivision final plat for Potter Pointe Subdivision, a 6-lot subdivision on 7.42 acres. The property is located in southwest Bismarck, between Mills Avenue and Larson Road, along the west side of Langer Lane (a replat of Lots 1-4, Block 1, Replat of Lots 1A, 2A and Part of 3A, Mills First Subdivision and the west half of the Langer Lane right-of-way).
• Request of Fairview Cemetery, Vertin and the City of Bismarck for approval of a zoning change from A-Agricultural and MA-Industrial zoning districts to the RT-Residential, MA-Industrial and P-Public zoning districts and a major subdivision final plat for Fairview Cemetery Addition, a 4-lot subdivision on 73.2 acres. The property is located in northeast Bismarck, along the south side of East Century Avenue between North 19th Street and Centennial Road (a replat of Auditor’s Lot A of the N1/2 of the NW1/4 and Lot 1, Block 1, Revolutionary Addition of the NE1/4 of Section 26, T139N-R80W/Hay Creek Township).
• Request of Brian and Barbara Frohlich for approval of a major subdivision final plat for Frohlich Addition, a 3-lot subdivision on 2.5 acres. The property is located in northwest Bismarck, west of North Washington Street along the north side of Colt Avenue (a replat of the East 314 feet of Lot 14, Block 4, KMK Second Subdivision and the north half of the Colt Avenue right-of-way).
• Request of Bismarck Public Schools for approval of a major PUD amendment for Hughes Addition to clarify the current use of the property within the PUD and a special use permit for an electronic message center sign to be located on Lot 1, Block 1, Hughes Addition. The property is located in central Bismarck, along the west side of North Washington Street between West Avenue C and West Boulevard Avenue (806 North Washington Street).
• Request of Grace Point/First Evangelical Church for approval of a special use permit for an electronic message center sign to be located on Lot 1, Block 1, First Evangelical Free Church, less that portion taken for right-of-way. The property is located in north Bismarck, east of North Washington Street in the southeast quadrant of the intersection of North Washington Street and Ash Coulee Drive/43rd Avenue NE (205 43rd Avenue NE).
• Request of Bismarck Public Schools for approval of a special use permit for an electronic message center sign to be located on part of Auditor’s Lot 1 of the SW 1/4 of Section 3, T138N-R80W/, Block 3, City Lands. The property is located in south Bismarck, in the northeast corner of the intersection of East Bismarck Expressway and South 12th Street (Myhre Elementary School – 919 South 12th Street).
• Request of Bismarck Public Schools for approval of a special use permit for an electronic message center sign to be located on Blocks 53-54, McKenzie and Coffins Addition and Blocks 65-66, Northern Pacific 2nd Addition. The property is located in central Bismarck, between North 7th Street and North 9th Street and between East Avenue C and East Avenue E (Bismarck High School – 800 North 8th Street).
• Request of Bismarck Public Schools for approval of a special use permit for an electronic message center sign to be located on Lot 1, Block 4, Edgewood Village 7th Addition. The property is located in northeast Bismarck, along the north side of East Calgary Avenue between Nebraska Street and Centennial Road (Legacy High School – 3400 East Calgary Avenue).
• Request of Bismarck Public Schools for approval of a special use permit for an electronic message center sign to be located on Lot 3 less the 7th Street right-of-way, Block 1, Meadow Valley Addition. The property is located in south Bismarck, south of East Bismarck Expressway between South 7th Street and University Drive (Wachter Middle School – 1107 South 7th Street).
• Request of 43rd Bismarck, LLC for approval of a special use permit for a drive-through in conjunction with a food establishment to be located on Lot 3A of Lot 3, Block 1, Christianson First Addition. The property is located in north Bismarck, west of US Highway 83/State Street along the north side of 43rd Avenue NE (820 43rd Avenue NE).
• Request of Kirkwood Mall Acquisition, LLC for approval of a special use permit for a drive-through in conjunction with a food establishment to be located on Lot 4, Block 1, Wachter’s Addition Second Replat. The property is located in central Bismarck, along the east side of South 3rd Street between East Indiana Avenue and East Bismarck Expressway (Kirkwood Mall).
At the hearings, the Bismarck Planning & Zoning Commission will provide an opportunity for all interested parties to be heard with respect to these items. Interested parties may submit written or email comments regarding these requests no later than 8:00 AM the day of the meeting to the Community Development Department, PO Box 5503, Bismarck, North Dakota 58506-5503, fax: 701-222-6450, or email. Written comments received after 8:00 AM on Wednesday, August 25, 2021 and those submitted anonymously will not be forwarded to the Planning & Zoning Commissioners or included in the minutes of the meeting. Interested persons may also call 701-355-1840 with questions, for additional information, or to facilitate alternate means to appear at the public hearing without having to appear in person.
Descriptions of these requests are on file and may be viewed or copied any working day between 8:00 a.m. and 5:00 p.m. at the Bismarck Community Development Department, 221 North 5th Street, Bismarck, North Dakota.
