Notice is hereby given that the Bismarck City Commission will hold public hearings on Tuesday, June 23, 2015, at 5:15 p.m. in the Tom Baker Meeting Room, City-County Building, 221 North 5th Street, Bismarck, North Dakota, to consider the following items:
• Request of Benchmark Developments, LLC for approval of the annexation of Heritage Ridge Addition. The property is located in northwest Bismarck along the north side of 57th Avenue NW and west of North Washington Street (part of the SW1/4 of Section 8, T139N-R80W/Hay Creek Township).
• Request of Benchmark Developments, LLC for approval of a zoning change from the A-Agriculture zoning district to the R5-Residential zoning district for Heritage Ridge Addition. The property is located in northwest Bismarck along the north side of 57th Avenue NW and west of North Washington Street (part of the SW1/4 of Section 8, T139N-R80W/Hay Creek Township).
• Request of MDU/Williston Basin Pipeline and Benchmark Developments, LLC for approval of the annexation of Heritage Park Addition, all of the North Washington Street right-of-way from LaSalle Drive to 57th Avenue NW and the north portion of 57th Avenue NW from North Washington Street to 15th Street NW. The property is located along the north side of 57th Avenue NW and west of North Washington Street (part of the SW1/4 of Section 8, T139N-R80W/Hay Creek Township).
• Request of MDU/Williston Basin Pipeline and Benchmark Developments, LLC for approval of a zoning change from the A-Agriculture zoning district to the R5-Residential, R10-Residential, RM10-Residential and P-Public zoning districts for Heritage Park Addition. The property is located along the north side of 57th Avenue NW and west of North Washington Street (part of the SW1/4 of Section 8, T139N-R80W/Hay Creek Township).
• Request of Daryl and Joan Scofield, Leona Kohler and Verity Homes of Bismarck, LLC for approval of the annexation of Ash Coulee Estates Addition. The property is located in northwest Bismarck, along the south side of Ash Coulee Drive west of Valley Drive (a replat of Lots 1-18, Block 1, Ash Coulee Second Addition).
• Request of Michael Baumgartner Construction, Inc. for approval of a zoning change from the Conditional RM15-Residential and PUD-Planned Unit Development zoning districts to the Conditional R10-Residential, RM15-Residential and PUD-Planned Unit Development zoning districts for Hamilton’s First Addition First Replat. The property is located in northeast Bismarck, along the east side of Hamilton Street between East Century Avenue and East Calgary Avenue.
• Request of Donald and Jeanne Reuter for approval of a zoning change from the A-Agriculture zoning district to the R5-Residential, R10-Residential, PUD-Planned Unit Development and P-Public zoning districts for Reuter’s Addition. The property is located in northeast Bismarck, along the west side of 52nd Street NE, east of Roosevelt Drive between 43rd Avenue NE and East Century Avenue (the SE1/4 of the NE1/4 of Section 24, T139N-R80W/Hay Creek Township).
• Request of Redland, LLC for approval of a zoning change from the A-Agriculture and CG-Commercial zoning districts to the MA-Industrial and P-Public zoning districts for JMAC Industrial Addition. The property is located north of Bismarck along the south side of 71st Avenue NE approximately 1/4 mile east of US Highway 83 (a replat of Auditor’s Lots A & B in the NW1/4 of Section 10, T139N-R80W/Hay Creek Township).
• Request of Benedictine Sisters of the Annunciation, B.V.M. for approval of a zoning change from the A-Agriculture zoning district to the Conditional RM-Residential zoning district for Benedictine First Subdivision. The property is located south of Bismarck, along the west side of ND Highway 1804, south and southwest of the University of Mary Campus (part of the SW1/4 of the NW1/4 and part of Government Lot 4, Section 2, and part of Government Lots 1 and 2, Section 3, T137N-R80W/Fort Rice Township).
• Request of Dakota Sand & Gravel Co. for approval of a zoning change from the RT-Residential zoning district to the CA-Commercial zoning district on Lot 1A of Lot 1, Block 3, Pebble Creek Eighth Addition. The property is located in northeast Bismarck, along the north side of Century Avenue and the east side of Nebraska Drive.
• Request of the City of Bismarck for approval of a zoning ordinance text amendment relating to the P-Public zoning district. The proposed amendment would modify provisions for height restrictions based on proximity to residential zoning districts.
• Request of the City of Bismarck for approval of a zoning ordinance text amendment relating to appeals process of Commission/special use permits. The proposed amendment would clarify the appeal of a denial of a special use permit by the Bismarck Planning and Zoning Commission to the Bismarck Board of City Commissioners.
