Notice is hereby given that the Bismarck Planning & Zoning Commission will hold public hearings on Wednesday, October 23, 2013, at 5:00 p.m. in the Tom Baker Meeting Room, City-County Building, 221 North 5th Street, Bismarck, North Dakota, to consider the following items:
• Request of Thomas and Angela Oakland for approval of a zoning change from the A- Agricultural zoning district to the RR-Residential zoning district for Oakland Subdivision. The property is located northeast of Bismarck, along the south side of 84th Avenue NE, between 26th Street NE and 41st Street NE (part of the NW1/4 of Section 2, T139N-R80W/Hay Creek Township).
• Request of Thomas and Angela Oakland for approval of a final plat for Oakland Subdivision, a 17 lot subdivision on 40 acres. The property is located northeast of Bismarck, along the south side of 84th Avenue NE, between 26th Street NE and 41st Street NE (part of the NW1/4 of Section 2, T139N-R80W/Hay Creek Township).
• Request of Clairmont 3G, LLP and TSI Enterprises, LLC for approval of a final plat for Airway Avenue Addition, an 11 lot subdivision on 20 acres. The property is located in southeast Bismarck, along the south side of Airway Avenue and the west side of South 26th Street (the S1/2 of the S1/2 of the NE1/4 of Section 10, T138N-R80W/Lincoln Township).
• Request of BREI Estates, LLLP for approval of a minor subdivision final plat for BREI Estates First Addition Replat, a 15 lot subdivision on 23.08 acres. The property is located along the west side of North Washington Street between Ash Coulee Drive and 57th Avenue NE (part of the NE1/4 of Section 17, T139N-R80W/Hay Creek Township).
• Request of Alan Lerberg for approval of a special use permit to increase the total area of accessory buildings to 3,200 square feet on Lot 13B, Block 1, North Star Acres. The property is located northeast of Bismarck, south of 71st Avenue NE and west of North Star Acres Road (6808 North Star Acres Road).
• Request of 12th Street Investments, LLP for approval of a special use permit to allow the operation of a church in a multi-tenant building located on Lots 1-3, Block 2, and the S1/2 of the vacated Mayfair Avenue adjacent, Mayfair Managers Addition. The property is located in southeast Bismarck, south of Bismarck Expressway on the west side of South 12th Street (1012 South 12th Street).
• Request of the City of Bismarck for approval of a zoning ordinance text amendment relating to definitions and the downtown districts. The proposed ordinance would modify the definitions of brew pub and microbreweries to increase the number of barrels manufactured annually.
• Request of the City of Bismarck for approval of a zoning ordinance text amendment to Title 14 of the Bismarck Code of Ordinances relating to Zoning Administrator references. The proposed ordinance would clarify the duties and responsibilities of the Zoning Administrator, Building Official, Floodplain Administrator and Environmental Health Administrator.
At these hearings, the Bismarck Planning & Zoning Commission will provide an opportunity for all interested persons to be heard with respect to these items.
